Hong Kong’s data protection laws are set out in the Personal Data (Privacy) Ordinance (PDPO). This ordinance defines personal data subject rights, specific obligations for data controllers, as well as six data protection principles to govern collection, processing, holding and use. Furthermore, liability will be placed on data users should their agents or contractors violate requirements of the PDPO.

The PDPO was amended twice between 2012 and 2021, with the latter update taking effect on 8 October 2021. This amendment seeks to address acts of disclosing personal data without consent (doxxing), by creating liability for data doxxers as well as prohibiting publication or public availability of an individual’s name and HKID number together unless for direct marketing. Likewise, this clause will protect any combination of employee details found on staff cards such as name, company information and photographs in order to safeguard individuals’ personal data.

Since businesses should remain mindful of their existing obligations under the PDPO and ensure they have effective risk-managing mechanisms in place, businesses should remain alert for additional compliance measures related to personal data. It may become applicable in future, though.
